SSD vs SSI

Social Security Disability (SSD) versus Supplemental Security Income (SSI)

We help you fully understand all potential disability options in New York

In the United States we have two federal programs aimed at providing benefits and financial assistance to disabled persons throughout the country. These programs are Social Security Disability Insurance (SSDI or simply SSD) and Supplemental Security Income (SSI), both of which are administered by the Social Security Administration. Only individuals who have a disability and meet strict medical criteria may qualify for benefits under either of these programs. Before filing for either of these benefits, it is best to consult with one of our experienced New York disability insurance attorneys at Severance, Burko, Spalter & Masone, PC to determine which program you qualify under.

Our Social Security Disability attorneys help you decide the best path for you

The disability requirements are relatively the same under the SSD and SSI programs, both requiring that:

  • You are deemed “insured” by having paid enough Social Security taxes
  • You are not gainfully employed
  • You are experiencing a disability that has lasted or is expected to last at least 12 months

Additionally, for SSD you must be under the age of 65 to qualify. Often times, initial applications for SSD are denied based on lack of supporting evidence or a bad faith claim denial. Our attorneys can help you get your application right the first time to get you started receiving benefits as soon as possible. We also know how to handle claim denials and are prepared to see your claim through each step of the appeals process.

Severance, Burko, Spalter & Masone, PC provides SSI claims representation While the requirements for establishing your claim for long-term disability insurance in New York are similar for both SSD and SSI, Social Security Income is a need-based program for qualifying individuals based on age and health conditions. Here are some of the New York SSI guidelines:

  • Benefits are paid on the basis of financial need and apply to people age 65 or older, as well as blind and disabled persons
  • Beneficiaries must meet the living arrangements requirements
  • Qualifying recipients are automatically eligible for Medicaid

If you have questions or concerns about which program you qualify for, our attorneys are available to help you determine the best option for you.
